2. Acceptance of These Terms

By using this website or engaging with our products and services, you agree to be bound by these Terms and Conditions together with our Privacy Policy and any other terms specifically applicable to a particular product, quotation, order or service.

If you do not agree with these Terms and Conditions, please do not use the website or submit an order or quotation request through it.

Where a specific written quotation, sales agreement or other agreement contains terms that differ from these Terms and Conditions, the specific written agreement will apply to the extent of the inconsistency.

3. Website Use

You agree to use this website lawfully and responsibly.

You may not:

  • Use the website for unlawful purposes;
  • Attempt to gain unauthorised access to our systems;
  • Introduce malicious software or code;
  • Interfere with the operation or security of the website;
  • Copy or reproduce website content for unauthorised commercial use;
  • Use automated systems to excessively scrape or copy website content; or
  • Submit fraudulent, misleading or intentionally inaccurate information.

4. Product Information

We make reasonable efforts to ensure that product descriptions, specifications, images, dimensions and other information displayed on the website are accurate and up to date.

However, furniture may be subject to variations in colour, finish, materials, dimensions or other characteristics due to manufacturing processes, screen settings, natural materials or product updates.

Product images are provided for illustrative purposes unless expressly stated otherwise.

Where an exact specification is important to your purchase, we recommend confirming the specification with us before placing an order.

5. Product Availability

Products displayed on the website are subject to availability.

Displaying a product on the website does not necessarily mean that the product is immediately available for delivery.

Some products may be manufactured, imported, assembled or specially ordered. Estimated lead times will be communicated where applicable.

If a product becomes unavailable after an enquiry or order has been submitted, we will contact you to discuss available alternatives or the appropriate next steps.

6. Quotations

Because many of our products are supplied to schools, businesses and organisations in varying quantities and may require delivery, installation or customisation, we may operate primarily through a quotation process.

A request for a quotation submitted through the website does not constitute an order or guarantee that a transaction will be concluded.

A quotation may take into account:

  • Product selection;
  • Quantity;
  • Customisation;
  • Delivery location;
  • Delivery requirements;
  • Installation requirements;
  • Site requirements;
  • Applicable taxes;
  • Lead times; and
  • Other project-specific requirements.

Unless otherwise stated on the quotation, quotations are valid for the period specified on the quotation.

A quotation may be subject to supplier availability and may change if the requirements of the project change.

7. Prices

Prices displayed on the website or communicated by us are subject to change without prior notice, except where a specific price has been confirmed in a valid quotation or agreement and is subject to its stated terms.

Unless expressly stated otherwise, prices may exclude delivery, installation, customisation or other additional services.

All applicable taxes, including VAT where applicable, will be handled in accordance with South African tax requirements.

Where an error in a displayed price is identified before an order is accepted, we will take reasonable steps to notify you and provide the correct pricing.

8. Orders

An order is only considered accepted once Chairmans has confirmed the order in writing or otherwise accepted it through the applicable ordering process.

We may require additional information before accepting an order, including delivery details, product specifications or payment information.

For larger projects, school installations, custom furniture or other substantial orders, additional written terms may apply.

9. Payment

Where payment is required before production, dispatch or delivery, the applicable payment terms will be communicated in the quotation, invoice or order confirmation.

Payment methods available through the website may change from time to time.

Where payments are processed by a third-party payment provider, additional terms and conditions imposed by that provider may apply.

Chairmans reserves the right to delay processing or delivery where payment has not been received in accordance with the agreed payment terms.

10. Delivery

Delivery arrangements will depend on the products ordered, quantities, destination and applicable quotation or order terms.

Delivery dates and lead times are estimates unless expressly confirmed as guaranteed in writing.

Delays may occur due to circumstances outside our reasonable control, including supplier delays, manufacturing delays, transport disruptions, weather, strikes, shortages or other unforeseen circumstances.

We will make reasonable efforts to keep customers informed of material delays.

11. Delivery Access and Site Requirements

Customers are responsible for ensuring that the delivery location is reasonably accessible and suitable for delivery.

This may include ensuring adequate access for delivery vehicles, suitable entrances, lifts, loading areas, parking and clear access to the intended installation area.

Where site conditions prevent delivery or installation, additional costs, delays or rescheduling may apply where permitted by the applicable quotation or agreement.

12. Installation

Where installation is included in a quotation, installation will be performed according to the agreed scope of work.

Installation does not automatically include building alterations, electrical work, plumbing, structural work, removal of existing fixtures or other services unless expressly included in the quotation.

The customer is responsible for ensuring that the installation area is ready and accessible unless otherwise agreed.

13. Custom Furniture

Custom furniture may be manufactured according to customer-approved specifications, dimensions, colours, materials or designs.

Once production of a custom item has commenced, cancellation or changes may not be possible or may result in additional costs, subject always to the customer’s rights under applicable law.

Custom products may have reasonable manufacturing variations and tolerances that do not materially affect their intended use.

14. Returns, Refunds and Defective Goods

Our returns, refunds and product remedies are subject to applicable South African consumer protection law and the specific circumstances of the transaction.

Nothing in these Terms and Conditions is intended to limit or exclude any consumer right that cannot lawfully be limited or excluded.

If you believe that a product is defective, damaged, incorrect or does not correspond with what was agreed, please contact us as soon as reasonably possible with your order or quotation details and information about the issue.

We will assess the matter and provide the appropriate remedy where required by law or under the applicable agreement.

15. Inspection on Delivery

Customers are encouraged to inspect products when they are delivered and to notify us promptly of any visible damage, missing items or incorrect products.

Where possible, photographic evidence may be requested to assist with investigating delivery-related claims.

Failure to report visible damage immediately does not remove any rights that you may have under applicable consumer protection legislation.

16. Product Care and Use

Furniture must be used for its intended purpose and in accordance with any applicable care, assembly, safety or installation instructions.

Damage resulting from misuse, unauthorised modification, incorrect assembly, improper installation, excessive loading or use outside the product’s intended purpose may not be covered by applicable warranties or remedies, subject to your rights under applicable law.

17. Warranties

Where a manufacturer or supplier warranty applies to a product, the terms of that warranty may apply in addition to the rights provided by applicable South African law.

Any specific warranty period or warranty conditions applicable to a product will be communicated where relevant.

Nothing in these Terms and Conditions limits any mandatory warranty or consumer protection rights that apply by law.

18. Intellectual Property

Unless otherwise stated, all content on this website, including logos, branding, photographs, graphics, product descriptions, designs, text, layouts and other materials, is owned by or licensed to Chairmans Furniture Solutions.

19. Customer-Supplied Content

If you provide us with photographs, plans, drawings, specifications, logos, artwork or other material for purposes of a quotation or custom project, you confirm that you have the necessary rights or permission to provide that material to us.

You grant us permission to use such material solely to assess, quote for, design, manufacture or provide the requested products or services.

20. Website Availability

We aim to keep the website available and functioning properly but cannot guarantee uninterrupted or error-free access.

We may temporarily suspend, modify or discontinue parts of the website for maintenance, security updates, improvements or other operational reasons.

21. Third-Party Services and Links

Our website may contain links to third-party websites, payment providers, mapping services, analytics services or other external services.

Third-party services are governed by their own terms and privacy policies. Chairmans is not responsible for the content, availability, security or privacy practices of third-party websites that we do not control.

22. Privacy

Personal information submitted through our website is processed in accordance with our Privacy Policy.

23. Limitation of Liability

To the extent permitted by applicable law, Chairmans will not be responsible for losses caused solely by circumstances beyond our reasonable control.

Nothing in these Terms and Conditions is intended to exclude or limit liability where such exclusion or limitation is prohibited by law.

In particular, nothing in these Terms and Conditions limits any rights or remedies available to consumers under the Consumer Protection Act or other applicable legislation.

24. Events Beyond Our Control

We will not be considered in breach of these Terms and Conditions where our ability to perform an obligation is materially affected by circumstances beyond our reasonable control.

Such circumstances may include natural disasters, severe weather, fire, industrial action, transport disruption, supplier failure, government action, power failures, telecommunications failures, cyber incidents or other unforeseen events.

We will take reasonable steps to minimise the effect of such circumstances and resume performance as soon as reasonably practicable.

25. Electronic Communications

You agree that communications between you and Chairmans may take place electronically, including by email, website forms and other electronic communication methods.

Electronic records and communications may be retained as evidence of communications and transactions where permitted by applicable law.

Electronic transactions are subject to applicable South African legislation, including the Electronic Communications and Transactions Act 25 of 2002.

26. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes to our business, website, products, services or applicable legal requirements.

The latest version will be published on this page with the date on which it was last updated.

Changes will not retrospectively alter rights or obligations arising from a completed transaction except where permitted by law.

27. Complaints

We value our customers and aim to resolve complaints fairly and efficiently.

If you have a complaint regarding a product, service, delivery, quotation or transaction, please contact us using the details below and provide as much relevant information as possible.

We will review the complaint and endeavour to provide a reasonable response within an appropriate period.

28. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with in accordance with applicable South African law and the jurisdictional requirements applicable to the particular transaction and consumer.

Nothing in these Terms and Conditions prevents a consumer from exercising a right or pursuing a remedy available under applicable consumer protection legislation.

29. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where legally possible.

If a provision cannot be made enforceable, it will be severed to the extent necessary without affecting the validity of the remaining provisions.

30. Entire Agreement

These Terms and Conditions, together with any applicable quotation, order confirmation, agreement and referenced policies, constitute the terms governing your use of our website and the relevant transaction.

Where a specific written quotation or agreement contains terms that expressly differ from these Terms and Conditions, the specific agreement will govern the relevant transaction to the extent of the inconsistency.
